3. Our Services
Bestari provides legal services in the area of pension rights, EPF matters, civil service pension administration, and retirement planning under Malaysian law. Our services are available to clients located in Malaysia.
The information published on this website is provided for general awareness and does not constitute legal advice. Each client's circumstances are different, and any legal advice will be provided under a formal engagement and on the specific facts of your matter.
We do not advise on matters that fall outside the scope of Malaysian pension and retirement law. Where your matter requires expertise we do not hold, we will inform you and, where possible, direct you to appropriate referral.
4. Your Responsibilities
When using this website or engaging our services, you agree to:

6. Fees and Payment
Our current service fees are published on this website for transparency. These fees are denominated in Malaysian Ringgit (MYR) and are subject to revision. The fee applicable to your engagement will be confirmed in your engagement letter before any work commences.

Payment terms, accepted methods, and any applicable disbursements will be set out in your engagement letter. We do not commence substantive work prior to receipt of any agreed initial payment.
Refunds are considered on a case-by-case basis. Where work has not yet commenced on a matter, a full refund of any advance fee may be made. Where work has commenced, any refund will reflect the value of work completed to date. Please raise any concerns about fees directly with us so we may address them promptly.
7. Service Delivery Terms
Our services are delivered in accordance with the engagement letter signed by both parties. Additional terms specific to each service type include:
Scope and changes
The scope of each engagement is defined at the outset. If your matter develops in a way that requires work outside the agreed scope, we will discuss this with you before proceeding and confirm any revised fee arrangement in writing.
Timelines
We do not make commitments about the duration of matters where third parties — such as EPF, court registries, or opposing parties — control material steps in the process. We will keep you informed of progress and any delays.
Confidentiality
We maintain strict confidentiality in respect of all client matters and communications, in accordance with our professional obligations under the Legal Profession Act 1976 and the rules of the Malaysian Bar.
Client obligations
You agree to cooperate with us throughout your matter by providing information and documents we reasonably request in a timely manner. Delays in providing required information may affect the progress of your matter.
8. Disclaimers
The content on this website is provided for general information purposes and does not constitute legal advice. While we take care to keep information current and accurate, we make no representation that it is complete or current at any given time.
Legal outcomes depend on the specific facts and circumstances of each matter, the applicable law at the relevant time, and factors outside our control. We do not make any representations about likely outcomes, and nothing on this website should be read as a commitment to any particular result.

9. Limitation of Liability
To the extent permitted under Malaysian law, Bestari's liability to you in connection with the use of this website — as distinct from a formal legal engagement — is limited to direct losses that are a foreseeable result of our negligence. We are not liable for indirect, consequential, or special losses arising from your use of, or inability to use, this website.
Our liability in respect of a formal legal engagement is addressed in the engagement letter and is subject to our professional indemnity insurance coverage as required by the Malaysian Bar.
Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless Bestari Legal Counsel, its lawyers, and support staff from any claims, losses, or expenses arising from your use of this website in breach of these terms, or from any false or misleading information you provide to us in connection with an engagement.
11. Termination
Either party may terminate a legal engagement in accordance with the terms set out in the engagement letter. Bestari reserves the right to cease acting for a client where professional obligations require it — for example, in the event of a conflict of interest or a breakdown of the relationship of trust and confidence.
On termination, you will be invoiced for work completed to the date of termination. Your file will be made available to you or to a new legal representative as required.
Terms that by their nature should survive termination — including confidentiality, intellectual property, and limitation of liability — will continue in effect after the engagement ends.
12. Dispute Resolution
These Terms and Conditions and any engagement between you and Bestari are governed by the laws of Malaysia. Any dispute that arises will be subject to the jurisdiction of the courts of Malaysia.
Before initiating any formal proceedings, we ask that you contact us to allow us the opportunity to address your concern informally. Most issues can be resolved through open communication, and we will endeavour to respond to any concern within 10 working days.
If a dispute cannot be resolved informally, either party may consider mediation through the Malaysian Mediation Centre before commencing litigation.
13. General Provisions
Entire agreement: These Terms, together with your engagement letter, constitute the entire agreement between you and Bestari in respect of your matter and supersede any prior understandings.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce it on a future occasion.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our obligations where a matter is transferred to a successor practice.
Notices: Formal notices under these Terms should be sent to [email protected] or to our registered address by post.
14. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our services, changes in law, or other operational requirements. When changes are made, we will update the "Last Updated" date at the top of this page.
We recommend that you review these Terms periodically. Continued use of this website following any change constitutes your acceptance of the revised Terms. Changes to the terms of a formal engagement will be communicated in writing and will require your agreement before taking effect.
